The introduction of the General Data Protection Regulation (GDPR) in May 2018 was a game changer in data protection. Whilst it only made small changes to the fundamentals of data protection, it significantly increased the consequences of making mistakes – and that changed the landscape. The enforcement of breach reporting puts businesses at risk of significant reputation damage and regulatory fines. The GDPR also introduced tighter restrictions on where data on EU citizens could be processed. One of these requirements is that the transfer must only happen to countries deemed as having adequate data protection laws. Privacy Shield is designed to create a program whereby participating companies are deemed as having adequate protection, and therefore facilitate the transfer of information.
